Terms of Service

These Terms of Service (“Terms”) govern your use of Race Gator websites, applications, race registration services, community features, race director tools, and related services. Race Gator is operated by Racing Portal LLC (“Race Gator,” “we,” “us,” or “our”).
By accessing or using Race Gator, you agree to these Terms. If you do not agree, do not use Race Gator.
Eligibility and Accounts
You must provide accurate information when creating an account or using Race Gator services. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.
You may not use another person’s account without permission or create an account using false or misleading information.
Race Listings and Event Information
Race Gator provides race discovery and event information supplied by event organizers, public sources, users, and other sources. We work to maintain accurate listings, but we do not guarantee that every event detail is complete, current, or error-free.
Event dates, locations, distances, pricing, availability, registration deadlines, course details, policies, and other information may change. Users should verify important event details with the applicable race organizer when necessary.
Race Director Submissions and Claims
Race directors and event organizers may submit races, claim existing race listings, and use Race Gator tools to manage or promote events.
By submitting, claiming, or managing a race, you represent that you are authorized to act on behalf of the applicable event or organization and that the information you provide is accurate and not misleading.
Race Gator may review, approve, reject, edit, suspend, or remove submissions or claims when reasonably necessary to protect listing quality, users, event organizers, or the integrity of the platform.
Race Registration
Race Gator may provide registration services for certain events. When you register, you agree to provide accurate participant information and comply with the rules, requirements, waivers, and policies applicable to that event.
Registration eligibility, event participation requirements, age restrictions, deadlines, capacity limits, and event-day rules are determined by the applicable race organizer.
Race Gator may transmit participant and transaction information to the applicable event organizer and authorized service providers as necessary to administer the event.
Payments, Fees, Refunds, and Cancellations
Registration fees and other charges shown during checkout are due at the time of purchase unless otherwise stated.
Race Gator may use third-party payment processors to process transactions. By submitting payment information, you authorize the applicable payment processor to charge the selected payment method for the amount shown.
Refund, transfer, deferral, cancellation, and event-change policies may vary by race. Unless Race Gator expressly states otherwise, the applicable event organizer’s published policy governs participant refund and cancellation rights.
Race Gator does not guarantee that an event will occur as scheduled. Events may be postponed, modified, relocated, shortened, converted, or canceled due to weather, safety concerns, governmental action, organizer decisions, force majeure, or other circumstances beyond Race Gator’s control.
Waivers and Participation Risk
Participation in races and endurance events may involve physical exertion, travel, weather exposure, traffic, terrain, crowds, equipment, and other risks.
Where required, participants must review and accept the applicable event waiver or release before completing registration.
Race Gator does not organize or control third-party races unless expressly identified as doing so. Event organizers are responsible for event operations, safety planning, course management, permits, staffing, timing, medical support, and other event-day responsibilities.
Community Features and User Conduct
Race Gator may provide profiles, groups, posts, comments, messaging, or other community features.
You agree not to use Race Gator to harass others, impersonate another person, publish unlawful or abusive content, distribute malware, attempt unauthorized access, engage in fraud, interfere with platform operation, or violate the rights of others.
We may remove content, restrict features, suspend accounts, or terminate access when reasonably necessary to enforce these Terms or protect users and the platform.
User Content
You retain ownership of content you submit to Race Gator, subject to the rights you grant us below.
By submitting content, you grant Racing Portal LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, format, and use that content as reasonably necessary to operate, promote, and improve Race Gator and the applicable race listing or service.
You represent that you have the rights necessary to submit the content and that its use by Race Gator will not violate the rights of another person or organization.
Race Gator Content and Intellectual Property
Race Gator, its software, branding, logos, graphics, designs, databases, features, and other platform content are owned by Racing Portal LLC or its licensors and are protected by applicable intellectual property laws.
You may use Race Gator only for lawful personal or business purposes consistent with these Terms. You may not copy, reverse engineer, scrape, resell, reproduce, or exploit Race Gator services or content except as permitted by law or with our written permission.
Third-Party Services and Links
Race Gator may link to or integrate with third-party websites, registration services, payment processors, maps, email providers, social platforms, sponsors, timing companies, or other services.
We are not responsible for the content, availability, security, or practices of third-party services that we do not control.
Service Availability
We may modify, suspend, limit, or discontinue any part of Race Gator from time to time. We do not guarantee uninterrupted or error-free operation.
Maintenance, outages, software errors, internet failures, third-party service interruptions, security incidents, or other events may temporarily affect availability.
Disclaimers
Race Gator is provided on an “as is” and “as available” basis to the fullest extent permitted by law.
We do not warrant that race listings, event information, community content, third-party information, results, registration data, or other content will always be accurate, complete, current, available, or error-free.
Nothing on Race Gator constitutes medical, legal, financial, or professional advice.
Limitation of Liability
To the fullest extent permitted by applicable law, Racing Portal LLC and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Race Gator.
Race Gator is not responsible for injuries, losses, delays, cancellations, weather conditions, event operations, organizer conduct, course conditions, participant conduct, third-party services, or other circumstances outside our reasonable control.
Indemnification
You agree to indemnify and hold harmless Racing Portal LLC and its affiliates, owners, officers, employees, and service providers from claims, damages, losses, liabilities, and expenses arising from your misuse of Race Gator, your violation of these Terms, or content you submit that infringes the rights of others.
Suspension and Termination
We may suspend or terminate access to Race Gator if we reasonably believe an account is being used fraudulently, unlawfully, abusively, or in violation of these Terms.
You may stop using Race Gator at any time.
Privacy
Your use of Race Gator is also subject to our Privacy Policy.
Changes to These Terms
We may update these Terms as Race Gator evolves. When we make changes, we will update the effective date shown at the top of this page.
Your continued use of Race Gator after updated Terms become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
